The user must read and accept all of these terms and conditions of use before placing an order for a credencial.

Between the Company Gérard ALVERNI, doing business as Les Chemins Vers Compostelle, located at 28 rue Nicolas Caillebotte, 61700 Domfront en Poiraie, registered with the Alençon Trade and Companies Register under number N° 499 928 745, SIRET 499 928 745 00037, represented by Mr. Gérard ALVERNI, in his capacity as manager, duly authorized for the purposes hereof. The company can be contacted by email by clicking on the contact form accessible via the homepage of the site (contact button at the bottom of the page). Hereinafter referred to as the "Seller" or the "Company"

On the one hand, and the natural or legal person purchasing products or services from the company, hereinafter referred to as the "Buyer" or "Customer", on the other hand, it has been agreed as follows:

PREAMBLE

Mr. Gérard ALVERNI owns the rights to the products (pilgrim's notebooks and pilgrim's leaflet, also known as the "Credencial") exclusively for consumers, sold through his website (https://lescheminsverscompostelle.fr). The list and description of the goods and services offered by the Company can be found on the aforementioned website.

Article 1 - Purpose and general provisions

These General Terms and Conditions of Sale determine the rights and obligations of the parties in connection with the online sale of products offered by the Seller. These General Terms and Conditions of Sale (GTC) apply to all sales of products made through the Company's websites and are an integral part of the Agreement between the Buyer and the Seller. The Seller reserves the right to modify these terms at any time by publishing a new version on its website. The GTC applicable at the time of payment (or the first payment in the case of multiple payments) of the order shall apply. These GTC can be consulted on the Company's website at the following address:

General terms and conditions

The Company also ensures that their acceptance is clear and unconditional by setting up a checkbox entitled: (I have read and accept the general conditions), a link to the GTC and a validation click during the ordering process. The Customer declares that he has read all of these General Terms and Conditions of Sale, and if applicable, the Special Conditions of Sale relating to a product or service, and accepts them without restriction or reservation. The Customer acknowledges that he has received the advice and information necessary to ensure that the offer meets his needs. The Customer declares that he is legally capable of contracting under French law or validly represents the natural or legal person for whom he is committed. Unless proven otherwise, the information recorded by the Company constitutes proof of all transactions.

The credencial (or pilgrim's notebook) is not a classic product. Although sold, it is primarily a letter of credit (hence the name credencial) by which **Les Chemins Vers Compostelle** attests to the pilgrim status of the person whose name appears on the notebook to the actors operating on the paths (hosts, restaurateurs and various communities).
As a result, the company "Les Chemins Vers Compostelle" reserves the right not to systematically grant its recommendation to the applicant and therefore not to issue the pilgrim's notebook (credencial) without having to justify its decision.
In this case, if the customer has already paid for their order, it will be refunded.

Article 2 - Price

Products sold on the websites are priced in Euros, including all taxes (VAT), and are precisely determined on the product description pages. They are also indicated in Euros including all taxes on the order page, including shipping costs, regardless of the destination country. Depending on the nature of the products sold, customs duties or other local taxes, import duties or state taxes may be payable in certain cases. These duties and sums are not the responsibility of the Seller. They shall be borne by the buyer and are his responsibility (declarations, payment to the competent authorities, etc.). The Seller therefore invites the buyer to inquire about 1 these matters from the corresponding local authorities. The Company reserves the right to modify its prices at any time for the future. 2 Telecommunication costs necessary to access the Company's websites are the responsibility of the Customer.

Article 3 - Online contract conclusion

The Customer will have to follow a series of steps specific to each product offered by the Seller in order to place their order. However, the following steps are systematic:
➢ Information on the essential characteristics of the product;
➢ Choice of the product, if applicable, its options and indication of the Customer's essential data (identification, address...);
➢ Acceptance of these General Terms and Conditions of Sale.
➢ Following the instructions for payment, and payment for the products.
➢ Delivery of the products. The Customer will then receive confirmation by email of the payment of the order, as well as an order acknowledgment confirming it.
For delivered products, this delivery will be made to the address indicated by the Customer.
If the customer cannot find this order confirmation email, then they are invited to check their mailbox in the folder reserved for spam emails.

If the customer still cannot find the order confirmation email, they are invited to contact us by one of the following means:
- By telephone on 02 33 66 80 43 every day from 9 am to 11 am and from 6 pm to 7 pm except Saturdays, Sundays and public holidays.

- Or by the contact form available on the company's websites (contact button at the bottom of the page)

In case of payment by credit card or PayPal account **via Stripe or the PayPal website**, PayPal or Stripe will send the customer a summary email with a transaction number justifying their payment. This email must be kept by the customer until receipt of the order.

For the proper completion of the order, and in accordance with Article 1316-1 of the Civil Code, the Customer undertakes to provide accurate identification details. The Seller or banking intermediaries reserve the right to refuse the order, for example for any abnormal, incomplete, fraudulent request, presenting an address problem, or for any order from a customer with whom there is an ongoing dispute regarding payment of a previous order until the dispute is resolved or for any other legitimate reason.

Article 4 - Products and services

The essential characteristics of the goods, services and their respective prices are made available to the buyer on the company's websites. The customer acknowledges having received details of the terms of payment, delivery and execution of the contract. The Seller undertakes to honor the Customer's order within the limits of available product stocks only. Failing this, the Seller will inform the Customer by email. This contractual information is presented in detail and in French. In accordance with French law, they are summarized and confirmed when the order is validated. The parties agree that the illustrations or photos of the products offered for sale have no contractual value. The validity period of the product offer and their prices are specified on the Company's websites, as well as the minimum duration of the contracts offered when they relate to a continuous or periodic supply of products or services. Except in special conditions, the rights granted under these terms are granted only to the natural person signing the order (or the person holding the email address provided).
In accordance with the legal provisions on conformity and hidden defects, the Seller will reimburse or exchange defective products or products that do not correspond to the order. The refund can be requested in the following way:
- By telephone on 02 33 66 80 43 from Monday to Friday from 9 am to 11 am and from 6 pm to 7 pm
- by contact form.
- The buyer shall return the product by postal mail, with the return costs being the responsibility of the buyer. "Les Chemins Vers Compostelle" will reimburse the Buyer for all sums paid at the time of the order, as soon as possible and no later than thirty days from the date of receipt of the item by the company.

Article 5 - retention of title clause

Under the retention of title clause, ownership of the goods will not pass to the buyer until full payment has been received.

Article 6 : Shipping methods

There is no guarantee regarding delivery times. The delivery deadline varies depending on the customer's address. For an address in metropolitan France, it is set at 15 days after the payment date, and for other destinations, at 20 days after the payment date.

The order is shipped by postal mail by the company La Poste. The company La Poste is solely responsible for delivery times.

The company Les Chemins Vers Compostelle cannot be held responsible for delivery delays exceeding 20 days due to a malfunction of postal services, a pandemic leading to a lockdown, a reorganization of postal services, strikes (regardless of the origin of the strike), or various social movements preventing delivery within the deadlines.

Products are delivered to the delivery address indicated on the order, and the estimated delivery date is the one indicated on the order form (and on the order summary email). When delivery requires an appointment with the Customer, as is the case for Colissimo shipments and registered mail with or without signature, the customer undertakes, in the event of absence when the carrier calls, to collect the goods within 8 days at the address indicated on the delivery notice left by the carrier. Otherwise, the uncollected order will be returned to the company by the carrier.
Similarly, if our shipment is returned to us by La Poste due to an address problem, i.e., with the La Poste sticker (unknown at the address, or lack of access), it will be considered that this return is due to a fault of the customer, either in the drafting of the order form (generally an address considered incomplete by La Poste), or an addressing error on site (no name on the mailbox, access code to the mailboxes, missing street number).
In the aforementioned cases, the customer will be refunded for their purchase minus the costs incurred by "Les Chemins Vers Compostelle".

If the delivery is delayed by more than 20 days, the Customer may terminate the contract under the terms and conditions defined in Article L 138-2 of the Consumer Code. The Seller 1 shall then refund the price of the product under the conditions of Article L 138-3 of the Consumer Code. The Seller provides a telephone contact point (cost of a local call from a landline) indicated in the order confirmation email 2 to track the order. The Seller reminds the Customer that upon physical receipt of the products, the risk of loss or damage to the products is transferred to the Customer. It is the Customer's responsibility to notify the carrier of any reservations 3 concerning the delivered product./p>

Article 7: Availability and Presentation

Orders will be processed subject to stock availability. If an item is unavailable for a period exceeding 5 business days, you will be immediately notified of the expected delivery time and the order for that item may be canceled upon simple request. The Customer may then request a credit note for the amount of the item or a refund.

Article 8 : Payment

Payment is due immediately upon ordering. We do not accept bank transfers. The Customer may pay by one of the payment cards accepted by Paypal or pay from a Paypal account. In both cases, the customer is redirected to the Paypal website, our payment provider. The customer may also pay by check, provided that it is a check made out in euros from a French bank with a branch and headquarters in France (including Overseas Departments and Overseas Territories). We do not accept checks from banks that are not located in France.
Cards issued by banks domiciled outside of France must be international bank cards (Mastercard or Visa). Secure online payment by credit card is handled by our payment provider Paypal. The information transmitted is encrypted according to the state of the art and cannot be read during transport over the network (HTTPS site address). Once the payment is initiated by the Customer, the transaction is immediately debited after verification of the information. In accordance with Article L. 132-2 of the Monetary and Financial Code, the payment commitment given by card is irrevocable. By communicating their bank details during the sale, the Customer authorizes Paypal to debit their card with the amount corresponding to the indicated price. The Customer confirms that they are the legal holder of the card to be debited and that they are legally entitled to use it. In the event of a technical error during the payment process, whatever its origin, or the impossibility of debiting the card, the sale is immediately terminated by right and the order canceled. The customer is then notified by email within 24 hours of the transaction.

Article 9 : Withdrawal period

In accordance with Article L. 121-20 of the French Consumer Code, "the consumer has a period of fourteen clear days to exercise their right of withdrawal without having to justify reasons or pay penalties, except, if applicable, return costs". "The period referred to in the preceding paragraph runs from the date of receipt for goods or acceptance of the offer for services". The right of withdrawal may be exercised by contacting the Company as follows:
- By telephone on 02 33 66 80 43, Monday to Friday from 9am to 11am and from 6pm to 7pm (except Saturdays, Sundays and public holidays)
- By email via the contact form.

   

In the event of exercising the right of withdrawal within the aforementioned period, only the price of the product(s) purchased and the shipping costs will be refunded, the return costs remain the responsibility of the Customer. Products must be returned in their original condition and complete (packaging, accessories, instructions, etc.) so that they can be resold as new; they should if possible be accompanied by a copy of the proof of purchase. The customer must indicate: - Name and delivery address specified when ordering, order date, a telephone number where the company can reach them.
Refund procedure:

If the right of withdrawal is exercised, and after receiving the returned item, the company "Les Chemins Vers Compostelle" will refund the Purchaser of all sums paid at the time of the order, as soon as possible and at the latest within thirty days of the date on which this right was exercised.

If the payment was made by credit card, the refund will be credited to the bank account of the credit card used for the purchase within a maximum of 20 days.
If the payment was made from a Paypal account, the amount will be credited to the buyer's Paypal account within a maximum of 20 days.
If the payment was made by check, a check will be sent within a maximum of 20 days, to the delivery address indicated by the buyer at the time of the order.
If the withdrawal occurs before the order is sent, we undertake to refund you within 7 working days.

Article 10 - Customer relations - After-sales service - Complaints

For any information, questions or complaints regarding an order that has been placed and confirmed, the customer can contact the company's Customer Service department.

Article 11: Intellectual Property Rights

The trademarks, domain names, products, software, images, videos, texts or more generally any information subject to intellectual property rights are and remain the exclusive property of the seller. No transfer of intellectual property rights is made through these General Terms and Conditions. Any total or partial reproduction, modification or use of these assets for any reason whatsoever is strictly prohibited.

Article 12: Force Majeure

The Seller's performance of its obligations under these Terms shall be suspended in the event of a fortuitous event or force majeure that prevents such performance. The Seller shall notify the Customer of the occurrence of such an event as soon as possible.

Article 13: Severability

If any provision of this contract is held to be invalid, such invalidity shall not affect the validity of the remaining provisions, which shall remain in full force and effect.

Article 14: Data Protection

In accordance with the French Data Protection Act of 6 January 1978, you have the right to access, rectify, and oppose the processing of your personal data. By accepting these General Terms and Conditions, you consent to our collection and use of this data for the performance of this contract. The Company undertakes to use your personal data only for the processing and follow-up of your order. The data entered in the order form on the website https://lescheminsverscompostelle.fr is not communicated to third parties. We track traffic on all our websites for statistical purposes. To do this, we use tools such as the implementation of cookies. The customer is informed of their presence when they first visit the site. They must then accept their use to remove the warning banner.

Article 15: Governing Law

All clauses contained in these General Terms and Conditions, as well as all purchase and sale transactions referred to therein, shall be governed by French law.

The Commercial Court of Alençon shall have exclusive jurisdiction in the event of any dispute or disagreement concerning the company Les Chemins Vers Compostelle.
